Whaa??

I agree with both Rob and Jonathon.

And maybe the Newsagent should be prosecuted for failing to provide a statement of particulars for his (obvious) employee.

Surely the fact that he carried out work for the newsagent and received remuneration means that he did have a contract, even if unwritten?

Isn't this embodied in contract law?

just shows waht a mess or legal system is in. if Myles had been a temporary employee - employed for some two years, no doubt he would have been reated as an employee (not self employed) by HMRC for the purposes of tax and NI.

Presume Sturry News paid him and he was, therefore, their employee under HASWA?
