Bizarre stuff out there as Banks won't always accept a passport either yet will accept a driving license that could have any name you choose on it and oddly enough won't accept the old CRB check that tracked identity, residence and domocile too boot...............

NHS Medical card and driving license seam to be more acceptable than a passport whas it all that about then ?

Hi Kelly,

Unfortunately the legislation is not entirely clear regarding expired passports, however it would appear from the wording of the The Immigration(Restrictions on Employment) Order 2007 that the passport needs to be valid to satisfy their criteria.
A UK passport describing the holder as a British citizen can be provided as evidence although the words "current" or "valid" are not used to describe the UK passport, the legislation does however require the employer to copy the page of the passport that contains the date of expiry, by implication that it should be valid and indate. Hi James,

That is the question I am trying to get to the bottom of. Surely to have a passport issued, whether out of date or not, indicates that the person in question has satisfied the Governments requirements for being a British citizen. Therefore accepting an out of date one should not make a difference. I'm not sure if this is correct from a legal point of view and would appreciate some legal guidence.

My current passport hasn't got long to run. Under the legislation a passport issued in 2001 would certainly be valid as ID. I fail to see why a passport dated 1999 or even 1995 wouldn't be acceptable ID. If you have a guy who starts work this year and works for another 40 years, then the ID you have on file could well be a 2001-issued passport which in 2050 will be very out of date indeed.

Hi,
I wonder if anyone can help me? I am in the process of gathering identification from employees in accordance with the Act and one employee has given me an expired passport as his identification. Is this acceptable or will I need to go back to him and get other 'in date' ID? I was under the impression that an expired passport would be acceptable as it still shows the employee is a British citizen. The photo is quite old but clearly still of the employee. What would be my best course of action here?
