Can somebody please advise me:-

I have a colleague who is approaching 65 and at the moment is on a part time contract for 12 hrs pay per week.

The employer is stating that at 65 they no longer will give him a contract and he will be termed 'casual',i.e brought in as and when required.

Is this legal? Or age discrimination?

Further to this article, the CBI has 'cautioned' the Government that banning UK retirement at 65 risks embittering the retirement process and could lead to a costly surge of employment tribunal cases.

The CBI makes clear that unfair discrimination based on age is unacceptable but says that the current retirement system enables individuals to retire with dignity rather than in conflict.

The employers' organisation says employees should not have a unilateral right to remain in employment after 65, but flexibility must be encouraged so that staff can discuss earlier or later retirement to meet their individual choices and pensions concerns.
