Hi, if you employee works four days one week then 2 days the next week you could average the working week so the employee works an ave of 3 days per wk. Holiday entitlement would be 4.8wks * 3 = 14.40 days per year. This could include bank holidays but will depend what is written in the employee's contract. Full time staff are entitled to 4.8wks * 5 days = 24 days holiday per year (statutory minimum). This can include all the bank holidays but again this will depend on what is stipulated in their contract. OR it may be easier for you to calculate your part-timers holiday entitlement as hours. The holiday entitlement of 4.8wks is equivalent to 10.20% of the hours worked. The 10.20% figure is 4.8wks holiday divided by 47.2 wks( being 52 wks - 4.8 wks). The 4.8wks have been excluded from the calculation as the employee wouldn't be present during those 4.8wks in order to accumulate annual leave. So if an employee works for example 40 hrs one week then 20 hrs the next week. They would be entitled to 4 hrs 5 mins (244.80 minutes) holiday one week then 2 hrs 2.4 mins (122.4 minutes) holiday the next week. The holiday entitlement is approx. 6.12 minutes for each hour worked. Hope this helps.

Hi I need some help on a issue relating to one of my staff, our full time staff are entitled to 20 days and Bank Holidays if they have a bank holiday off they get paid and if they work it they get paid and have a day in leiu off aswell. As regard to my part timers one of which works Mon Tues Sat Sun one week and Mon Tues the next week alternating what do I have to offer her, with regards to Statutory Holiday and Bank Holidays pro rata to the rest. Hi your friend is entitled to the statutory minimum of 19.2 days. This can include bank holidays, but depends on your friends employment contract. As of 1st October 2007 the statutory holday entitlement increased to 4.8 wks for a 5 day week = 24 days. So 24 days divided by 5 days times by 4 days = 19.2 days.

A friend recently applied for a job, and was ofered the job, but when she enquired about the holiday entitlement she was told that she would get 10 days per annum. The job is for 20 hours per week - 5 hours a day Monday to Thursday. What is the legal minimum for part-time workers?

We currently give 22 days + 8 days statutory holiday. Do we have to increase this to 24 days + 8 days stats from 1.10.07?

Hi Ralph

As your employees currently get bank holidays in addition to the service-related holiday, you don't need to give them additional holiday.

The legislation is bringing the total minimum holiday up to 24 days per year, but this can include bank holidays.

However you may need to check the wording of your employment contracts. If these provide for statutory holiday under the Regulations plus bank holidays such contracts will, inadvertently, have the effect of providing workers with more holiday than you perhaps intend.

We currently give 25 days after 12 employment, which is based on 2 days per month plus 1 day for completion of 12 mnoths service, employees are also entitled to all public and bank holiday, do we have to give more than this?
