The new ruling only affects companies where the holiday entitlement is 20 days including public holidays. This is the current statutory minimum. The new ruling will increase that entitlement to 24 days including public holidays
We have recently changed our holiday policy to include public holidays giving us the ooportunity to take public holidays as we wish or take them as annual leave. Does the new ruling with additional 4 days affect what we have now?
The current minimum holiday entitlement -including statutory holidays - is 20 days. This is expected to change in October to 24 days.
You can specify when holidays need to be taken as long as you advise the employee at the time of appointment. You need to consider what is the business case for doing this as this might not make you an attractive employer to work for.
I would not advise that you specify when all their entitlement can be taken as this could indirectly discriminate against some employees.
