The Government has published the first draft of the Flexible Working (Procedural Requirements) Regulations 2002, made under the Employment Act 2002. They are intended to come into force on 6 April 2003. The Employment Act 2002 gives employees with children under six a right to request flexible working. The employer is under no duty to accede - but must consider the request, hold a meeting with the employee if it intends to refuse, and put its reasons for refusal in writing. The draft of the Flexible Working (Eligibility, Complaints and Remedies) Regulations 2003 have been published. These are in addition to the Flexible Working (Procedural Requirements) Regulations 2003, reported on the Network on 25 November 2002. The new Regulations provide: - that a request for flexible working can only be made if the employee has been continuously employed for six months; and - a penalty if the employer fails to hold a meeting with the employee, or fails to notify the employee of his decision, of up to eight weeks' pay.
