Construction Act: New rights for contractors

All maintenance contracts entered into since May 1998 will be affected by the landmark judgment in the case of Powerminster Ltd -v- Nottingham Community Housing Association. This could result in a big rise in contract disputes being settled by adjudication.The judgment means that a contract for the maintenance of a building can be treated as a construction contract under the Housing Grants, Construction and Regeneration Act 1996.
