TUPE: first Employment Tribunal finding on service provision changes

The Employment Tribunal has found that an employee transferred under TUPE 2006 when a client changed PR agencies.
TUPE applies on a service provision change, such as a change in service provider, where;


before the change there is an organised grouping of employees whose principal purpose is to carry out the activities concerned on behalf of the client; and
