The Employment Appeals Tribunal (EAT) has given its first interpretation of the meaning of ‘same job’ when referring to women returning to work following maternity leave.
The courts have been grappling with the meaning and approach to the ‘the same job’ provision which states in regulation 18 of the Maternity and Parental Leave Regulations 1999:
