HM Prison Service v. Potter - EAT - Race Discrimination
The EAT has held that a race discrimination claim brought by a BNP member against HM Prison Service should not be struck out because although his case was very weak, it still could not be said that it had no reasonable prospect of success (which is the proper test for strike out applications).
