Barrow Borough Council had no safety adviser in place at the time a new maintenance contract for the air-conditioning system for the Forum 28 building was being negotiated. Testing and dosing of the cooling towers was not included in the maintenance contract between the Council and its contractor, Interserve.
Preston Crown Court yesterday (5 July) heard evidence from the council's safety adviser at the time of the outbreak, Andy Buck.
