In a case where an employee was dismissed for drug abuse and timekeeping problems, and the employer genuinely believed that the offences had been committed, trust and confidence had broken down. On this basis the EAT ordered that it was not appropriate to make a finding that there should be re-engagement as that would be ordered only in the very rarest cases where there has been a breakdown in trust and confidence.
