The European Court of Justice (ECJ) has given a key ruling on the information and consultation obligations of an employer proposing to make more than 20 redundancies.
The obligation to consult on a collective basis arises from the Collective Redundancies Directive, implemented in the UK by the Trade Union and Labour Relations (Consolidation) Act 1992 (TULRCA).
