Howard -v- Millrise Ltd (in liquidation) and another

The applicant's employer, the first respondent, went into liquidation and its business was transferred as a going concern to the second respondent. There was no recognised trade union and no elected employee representatives. As a result of the transfer the applicant was made redundant without prior consultation.
