The Employment Appeals Tribunal (EAT) in Asda Stores -v- Thompson and ors (No.2) has ruled that confidential statements taken as part of a disciplinary investigation that led to an employee’s dismissal were relevant for the purposes of subsequent unfair dismissal proceedings and were disclosable to the claimant employee. However, the identities of the persons who made the statements were not relevant and any information that could identify them should be edited out.
