Reform of the law of the tenement in Scotland

On 28 November 2004, the Tenements (Scotland) Act 2004 will come into force. This date is also the long-awaited 'appointed day' on which the Scottish feudal system will be abolished.

A centuries old set of common law rules regulating tenemented property is already in place, but these are considered to be unsatisfactory in dealing with the key issues:

Ownership - Who owns what?
Maintenance - Who is to pay?
Management - How are decisions to be made?
