The Court of Appeal has handed down its decision in the case of Roberts -v- West Coast Trains Ltd.
Mr Roberts worked for West Coast Trains for over 25 years. He was dismissed for gross misconduct on 6 November 2001. Two days later, he lodged an appeal against dismissal.
The internal appeal hearing took place on 6 February 2002 but, to protect his position, Mr Roberts presented an unfair dismissal claim the day before. His appeal succeeded, and a penalty of demotion was substituted.
