One of the hot topics for employers over the last 12 months has been the implementation and effectiveness of e-mail and Internet policies. The recent case of Royal Bank of Scotland -v- Miss S J Goudie [2004] is a valuable illustration of how misuse of a company e-mail system is analysed by the courts in the context of an unfair dismissal claim. It illustrates how even the most carefully thought out policy can come unstuck if it is not communicated properly to employees.
