A husband and wife were employed by the same company and received a low basic salary which was supplemented by commission on sales achieved. They allocated the commission between themselves in the manner which was most tax efficient to them. Following their dismissal the couple pursued claims of unfair and / or wrongful dismissal. The tribunal found that they had no remedy because their contracts of employment were tainted with illegality as they amounted to a fraud on the Inland Revenue.
