Are employees legally entitled to take Bank Holidays off? This question has been re-visited a few times on the Workplacelaw Network, but remains a matter of confusion for many employers.
The answer is 'no'; there is no statutory right to take bank holidays off. If an employee takes a Bank Holiday as a paid leave, it can count as one day of his/her annual leave entitlment under the Working Time Regulations. Entitlement to public holidays is governed exclusively by the employment contract.
