The recent decision in Interserve Project Services Limited v K Systems Limited by Lord Eassie, Court of Session is a salutary lesson to Contractors and Sub-Contractors alike when rectifying/remedying defectives beyond the contractual period.
K Systems, Sub-Contractors, had laid a floor for Interserve, the vinyl of which subsequently de-bonded in part. There was no defects liability period within the Sub-Contract. Post practical completion K Systems agreed to carry out rectification works... (249 more words)
