The recent case of Middlesbrough Borough Council -v- TGWU considered the issue of consultation by an employer prior to collective redundancies.
In April 1998, Middlesbrough Council anticipated that its budget deficit would rise to £2m by the end of the financial year Therefore, the Council decided that it would be necessary to cut cost by reducing staff in one particular department.
