The European Court of Justice (ECJ) recently had to decide whether terms
entitling an employee to an early retirement pension and lump sum on
dismissal for redundancy should have transferred with the employee from her
public sector employer to a private sector employer under the Acquired
Rights Directive (implemented in the UK via the TUPE Regulations).
In the case (Beckman -v- Dynamco Whicheloe Macfarlane Ltd), Mrs Beckman was a
