Directive 2002/14/EC has now been published and sets out the minimum requirements, which will apply to the right of employees to be informed and consulted “in relation to matters which affect or may affect their employment.” This will therefore extend the circumstances where employers are under a duty to consult. Current obligations relate only to proposed TUPE transfers and redundancies.
