Confusion has arisen over the payment of holiday pay to many casual and part-time employees, as a result of a recent decision of the EAT in Scotland.
In MPB Structure Ltd -v- Munro (28/03/02) an increase of 8% was made in employee’s weekly wage to provide for their holiday pay. The employment tribunal found that this was contrary to the Working Time Regulations 1998 and therefore held that it is not permissible for an employer to pay holiday pay, as part of employees' weekly wages, in adv...
