The decision in ESSO Petroleum -v- Jarvis delivered by the Employment Appeal Tribunal is yet another case to add in the rapidly growing case law regarding the classification of agency workers.
ESSO employed workers through an employment agency, which, in turn, paid those workers at rates set by ESSO. The tribunal interpreted whether the applicants were employed by ESSO by reference to their employment circumstances.
It found that the workers:
