A definitive statement of the obligation of trust and confidence was given
in the case of Malik & Anor -v- Bank of Credit and Commerce International
SA [1998]. The House of Lords held that an employer will breach the term
if it "without reasonable or proper cause conducts itself in a manner
calculated or likely to destroy or seriously damage the relationship of
trust and confidence between employer and employee".
