In Galt & Others v. National Starch & Chemical Limited (2008) the Tribunal held that the employer had failed to justify its use of enhanced redundancy payments which had been calculated on the basis of age and length of service but which did not mirror the statutory redundancy payment scheme. The employer did not therefore fall within the exemption at Regulation 33 of Employment (Equality) Age Regulations 2006, so its redundancy scheme was unlawful.
