The latest raft of provisions under the Companies Act 2006 (2006 Act) came into force on 1 October 2008.
The simplification of capital maintenance rules for private companies and the codification of the law relating to conflicts are the two most significant areas of the 2006 Act which came into force on 1 October 2008.
The abolition of the prohibition on private companies giving financial assistance will greatly simplify a number of transactions, including acquisition financings.
