The High Court decision in Hays Specialist Recruitment v Ions is a useful reminder that employers can force ex-employees, who may have set up in unlawful competition, to show their hand, without the employer bringing expensive injunction proceedings.
This pre-action disclosure can help the employer assess the merits of then making an injunction application and estimate the possible damage to their business.
