Appearances can matter. We all remember Melanie Griffiths’ secretary in the film Working Girl, held back from the big-time by big hair and a tendency to over-accessorize.
As soon as her wardrobe went upmarket, so did her career. So much for the movies – what about real life and the thorny world of discrimination? Are there any circumstances where an employer may take appearance into account, without putting itself at risk of litigation?
There is, of course, no legislation in place specifically addressing discrimination based on appearance. However, appearance-related issues crop up across the existing spectrum of discrimination statutes. Moreover, appearance related bullying or harassment can lead to constrictive dismissal and, in extreme cases, to stress claims.
