Most employers would be forgiven for believing that the changes to the Sex Discrimination Act and the Maternity and Parental Leave Regulations do not impact on an employer’s obligation to continue pension benefits during maternity leave. After all, the current guidance from the Government (on BERR’s website) is that “the employer need not continue pension contributions during unpaid [maternity] leave unless the contract provides otherwise.”
