Over the last few years there has been an increase in the number of claims and threats of claims concerning the 'whistleblowing' legislation.
Statistics show that the rewards are high – the highest award made has been £850,000 and the average is award is £107,000. The whistleblowing legislation is also known as a claim under the Public Interest Disclosure Act (PIDA).
Its core purpose is to encourage disclosures to be made internally, i.e., to the whistleblower's own employer or to any person who has been designated by the employer to receive relevant disclosure under an authorised procedure.
The intention is to reassure workers that it is safe and acceptable to make disclosures and to forewarn employers of any malpractice or wrongdoing and be given the opportunity to take steps to deal with the problem.
