The essential principle of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”) is set out at regulation 4(1). This provides that, where TUPE applies, the contracts of employment of the employees in question transfer from the transferor to the transferee. This ensures that, following the transfer, the transferring employees have the benefit of their pre-transfer contractual and statutory rights.
