Employers are generally aware that they must follow a fair process in selecting employees for redundancy.
The recent case of Ralph Martindale & Co Ltd v Harris highlights that employers must also ensure that they follow a fair process when looking at alternative employment for potentially redundant employees.
Due to a reorganisation two employees were at risk of redundancy. An alternative position was potentially available to these two employees but it was also advertised internally.
