Most employers are aware that dismissing an employee by reason of ill health can be a minefield. As well as potentially triggering disability discrimination liabilities, for those employees with one year or more of continuous service, an ill health dismissal could also give rise to a claim for unfair dismissal.
Although, ill health is a potentially fair reason for dismissing an employee, employers must ensure that the dismissal itself is carried out following a fair and proper procedure.
