The Employment Appeal Tribunal has found that if an employment contract which has been entered into in good faith turns out to be illegal it does not preclude a claim under contract or tort law.
In the first case the claimant entered into an agreement with the respondent employer that he would provide his services as an independent contractor, an arrangement that was accepted by the Inland Revenue.
