In order to implement the EU’s Equal Treatment Framework Directive, the UK introduced legislation outlawing discrimination on the grounds of age in October 2006. The introduction of the Employment Equality (Age) Regulations 2006 (the regulations) was the employment law event of the year. These regulations, which have now been in place for a year, are widely considered to be among the most important developments in UK employment law for many years.
The regulations affect every stage of the employment relationship life cycle, from recruitment to retirement. The law, which is now a year old, seeks to ensure equal treatment for all employees, irrespective of their age, unless an employer can justify different treatment. For many employers, complying with the regulations involves a shift in outlook combined with a major overhaul of workplace policies and practices. Age discrimination in the workplace was rife, and many businesses were far from being prepared for the new regime.
