Can anyone help please. If a (manual) worker has been diagnosed with a medical condition whereby there is a need for reasonable adjustment is there a point, in percentage terms, when dismissal on the grounds of capability becomes an acceptable option? In other words if a doctor advises that the worker can only carry out x% of his normal duties is it reasonable to dismiss?

It strikes me that the terminology here is all wrong. The LSE clearly used a twin bin system as does my department. Staff, in general, are so familiar with the concept of re-cycling that there is not much educating needed to persuade them to put re-cyclables in one bin and landfill waste in the other.

The question related to directly employed local government staff as opposed to contracted. Since writing the question in Nov I have attended a think tank at the SIA on this subject. The answer is - no change - yet.

The security officers in question are directly employed by the local authority and, as such, work for the public sector as opposed to the private.

I believe there is also a greater fire risk inside the building once the regulations are in force. There are some smokers in most workplaces who will find a store cupboard or something similar to avoid their having to go outside when it is raining. It is for sure that this cupboard etc will be full of flamable material and other detritus. If the Safety Manager does not know of the cupboard's existence - need I say more.

I see no mention of a Personal Emergency Evacuation Plan (PEEP). Such a document not only shows that the responsible person has given the matter consideration but, in my experience, gives great confidence to the, in this case, wheelchair user.

A small example. A prospective employee presented a paper from the Immigration Services showing that he had the right to live in this country. What it did not show was whether he had the right to work here. I contacted Immigration in Croydon and was first asked what form number I was looking at. On replying xxxx I was informed that with this form if it did not say he could not work here then he could. What chance any emplyer.

What is the current legal position if a member of staff asks to continue working beyond the normal retirement age of 65? Do staff have an automatic right to continue or can employers turn a request down?

The term "sick leave" seems wrong to me. There is "sickness absence" and there is "annual leave". Any time in hospital and recuperation, whether self referred or medically referred, is sickness absence. Anything else is annual leave.
