If this guy is telling the truth and he is self emoployed and does not allow any of his labourforce (however temporary) to ride in his van, then i believe his appeal will be successful.
I wonder how much training the council officials have had on the "Smokefree" regulations and whther they have sufficient competence and knowledge to avoid erroneously issuing on-the-spot fines when the driver is actually exempt from the regs.
Good point about the fact that he may have highly flammable materials in the back of his van. I wonder if he has conducted risk assessments? Although if he is self employed, he won't necessarily have to record his findings to prove it.
Hmmm?

Interesting topic to which I would like to join in and ask some advice:
Our office has a parttime administrator who I have noticed is slow moving and often need to rest-up and catch breath when going up or downstairs. The person in question is (i guess) over 60 years of age and often complains of stiff joints (Arthritis?).
How should I go about ascertaining whether a PEP is required for them?
