This comment is for the Online Advisor. We have occupied a commercial building (23,773sq ft) on a tenancy agreement since 2002 until 2012. Do we require an Energy Performance Certificate now or is it when we take on another building? Our current building was built in 1998.

I agree the policy should be communicated to all staff to ensure they understand their individual and collective rights and responsibilities through various communication channels, this is the statutory requirement. We manage three property portfolios and at each of these premises, the policy is displayed on the Health and Safety Notice Board (but this is our company choice) as well as on the intranet. Is the Council confusing your Health and Safety Policy Statement with the Safety Law Poster?

As we are prescribing one designated smoking area on the premises as from 1 July 2006,what is our stance to be over staff smoking in their own cars on the premises car park still in the Workplace?

With the smoking ban to be enacted next July, will the building perimeters at work places be included in the smoke free categories. Within the perimeters of the our premises, we have the office building and the car park. Can staff go out and smoke within the grounds of the building/car park? Where can I read a more in-depth clarification for this?
