well said Nigel, no matter where you go in this world the employer never takes cognizance of the fraility of the human factor. We are all little cogs in the big machine of commerce and as such are expendable. No matter how much legislation is put in place you cannot legislate against the human condition of difference, whether it be age, gender, education or class. Bearing in mind the new Corporate Manslaughter Act will, no doubt, have a major impact on those closer to bottom of the food chain as we do not have the financial backing to be able to drag out any action.

Surely the company should have thought about training the employee up to a standard they required. This would probably be more cost effective in the long term and there was the possibility then that they would have a loyal long serving grateful employee.
There are times when I despair of HR people not giving the right info to employers.

This country is probably one of the most highly taxed and now this!!! Our local Council will not allow us to put in more parking spaces, despite the fact our business is growing. They asked for A 'Green Travel Plan' which must include staff, patients and visitors being "bussed in". The closest bus stop is 1 mile away and our access road is too small to allow for buses. Is there any logic in what City Hall forces onto the normal everyday person and business.
I wonder if the Council employees pay for their parking??

Help needed please Guys & Girls,
am having an outside function with approximately 250 guests. Mixed bag of adults and children. Included will be the normal 'kiddies' items, ie. bouncy castle etc. BBBQ, bar and other catering all set in a carpark surrounded by a forest, there is a marquee and other covered facilities.
Any ideas or has anyone ever had to do a RA for something similar.??

Yes, our maintenance team have been trained by the lift company and this updated every 6 months. All motor rooms are kept locked with only the maintenance team having access to keys. We are fortunate in that we have hydraulic lifts which are are a lot easier to lower. It brings up the age old question of who is regarded as a 'Competent Person' and how long are they competent for?

I realise this is about 'disabled' workers and their benefits and rights but could this also apply to workers suffereing from chronic illnesses as well?? i.e. diabetes or tobacco related illnesses.
After all a disabled person is usually in this position due to no fault of their own, whereas it could be argued that diabetics or people suffering from asthma as a result of years of abuse to their bodies and should therefore not be entitled to the same sick benefits.
your comments on this anyone!!

I was reported by a fellow employee for a comment she had heard me saying and which she construed as being racist and inflammatory. As a result I was brought before a Tribunal and they then dismissed the allegation on the grounds that the group of people I was with at the time and all other witnesses to the event where actually black and the term was supposed to be derogatory to them and not one of them took offence. They all stood for my defence, which the Head of the Tribunal found very "encouraging" and blow for normality!!
By the way the complainant was white!!!
All of this took up Company time as well other members of staff and all in all probably cost about £5, 000.
I think if anyone actually took the time to find out from the normal everyday people, they really could be bothered with all this PC nonsense and just want to live their lives without it.

in regard to 'ageism' I feel that there are certain types of work that do require an idea of age as this would impact on whether the person is capable. Specifically physically demanding jobs ie. fire fighters, construction and steelworkers to name a few. This does give the prospective employer a chance to vet candidates before calling in for interviews, and before anyone starts bouncing off the walls, I'm in my 50's and work in a physically demanding job as well as being a manager. I know my own capabilities and can 'pace' myself a lot better than younger people in my position!! so there are pros and cons to this argument and each case should taken on merit, there is already a climate of over legislation in so much of the workplace that it is becoming almost impossible to have a normal conversation without the worry of being accused of some slip of the tongue.
And yes I do put my age as well as my sex and country of citizenship on my C.V. whenever I send it out.
