David, I would disagree, you call call up a history of your conversation on MSN Messenger for previous months unless you actually delete your contacts, these discussions can be recalled. I've done it a few times to remember what we were chatting about previously.

No, do you see any other country offering british language lessons? Why should the UK be burdened with this cost. More and more, the UK tax payer or employer is bearing the brunt of the Government not setting minimum immigration requirements i.e. if you want to settle or work here - learn the language first - do not expect funding to be available for interpreters like they do at the moment. But that would be common sense and where immigration is concerned, there is none.

Surely, if an organisation wants to project a professional image, especially with their sales staff, the tribunal should have favoured them in this case? Many organisations do not allow football colours but if tribunals are favouring 'clownism' what is going to stop them favouring 'Arsenalism' or 'etc.etc Come on people, surely this is going a little too far? Companies are putting people in employment and keeping the economy afloat, surely they have some rights themselves regarding their own company image? I feel that so called religions such as 'Clownism' belittles actual recognised religions and it sounds like this one was made up on a night out and scribbled on the back of a cigarette packet ! I can't believe they actually wasted money on this case at all.

Any good property manager would ask for this. I'm confused myself as to why your line manager is questionning this.
If you are going to manage the Property then it is important that you do know how the heating and ventilation system operates in that building. Common sense is it not?

I'm afraid to say that there is basis for a claim here. This individual done everything she could to advise the employer of the situation and the causes of her being off with stress and did maintain regular contact, The opportunity was there to resolve it and it does seem like it was briefly when she was moved to the other manager but then returned to the original manager who seemed to have been the catalyst for the problem. You also mentioned that the person was victimised by the manager because of her ethnic origin.
Harassment may be defined as conduct that is unwanted and offensive and which affects the dignity of a person.
Businesses may be held liable for bullying or harassment by their employees in the course of their work, the House of Lords ruled.
Harassment is often related to abuse of power and is defined as discriminatory treatment of a person based on specific characteristics such as sex, race, disability, sexuality, age or class.
The Race Relations Act and the Sex Discrimination Act state that "Anything done by a person in the course of his employment shall be treated for the purposes of this Act as done by his employer as well as by him, whether or not it was done with the employer’s knowledge or approval." In the Court of Appeal in Jones v. Tower Boot Company Limited, it was determined that employers may be held liable for sexual or racial harassment in a wide variety of situations.
You also mention 3 months - this no longer applies the time-limit for bringing an action under the 1997 Act is six years, as opposed to the time-limit of three months for an anti-discrimination claim under the employment legislation.
At this moment in time I would seek professional advise and review all company policies relating to conduct at work and send your managers for training as well as implement a good return to work policy via an Occupational Health provider.
I hope this helps.

Ha, teflon, I hear that statement on many occasions from a few people where I work. Extremely frustrating when people are not held accountable for their actions.

It's most likely to be coming from the underground rail. My previous employer has similar problems when the building was first opened.

I wonder if anyone can help? We have several properties around the UK that are managed by a large property management organisation. I have been trying to obtain essential health & safety information on each of our properties i.e. H&S Policy Statement of Intent, how do they maintain their access/egress, site specific risk assessments for the use of any chemicals onsite, how they assess the competence of any contractors they use on site, fire safety, plant & equipment maintenance regimes, including water management, air conditioning, lifts, electricity, DDA, copy of their Public Liability insurance etc.
The response I have had so far is 'why are you asking for this information?'. I have tried on several occasions and they have asked that I modify the questionnaire as I would struggle to get this information. However, I do not want to modify this as we are legally entitled to this and health & safety is all about producing the evidence that these areas are covered. And at present there is no evidence.
Any advice from an online advisor on how to progress this would be greatly appreciated as explaining 'duty of care, legal compliance' etc.etc. has still not made any difference.
