not missing too much at all. Point 1. Legal wheels do turn slowly, fact. Jury couldn't agree because as lay persons they probably couldn't get to grips with what was being talked about. That doesn't surprise me one bit. As for Scottish law, we are not in Scotland.
Pont 2. I agree you shouldn't go after the top man if persons below him have failed, you can't expect a CEO of a 20,000 strong company to know what each are doing.
Point 3. I am not defending or trying to prosecute anyone, but if I was in charge of that system and taking payment for that task and I failed to ensure it was maintained correctly I would expect the law to bounce all over me.

to avoid any client problems and how much it would cost you, I would just do it. My problems with cleaners do not normally stem from their Portable Aplliances but their training records, lack of MSDS, risk assessments and method statements.

The company should have ensured that no one could open the window to the extent that someone could have climbed out at that height. I think you are all under the sad illusion that all adult persons are fully compis mentis, sober or can make logical adult decisions. Not so. I can sit here all day proving that the general public are thick as two short planks and need protecting from themselves. Public places should be fully aware of this, the courts were right to find the hotel guilty.

Patrick, Lets let the law of the land decide the case and then we can all take stock of the situation when completed. We vote these people in to make the law so we can't whinge when its meted out. Do I take it you want everyone prosecuted? FM's and persons in charge of these kind of systems should either know what they are doing or ship out of the job quickly. Its not an easy money profession.
