Sorry for not reading all the posts here, but has a Stress Risk Assessment been carried out by the employer?

A self assessment can only be carried out if the person has undertaken DSE workstation training, otherwise they will not be competent to assess their own workstation.
Managers or their delegate should attend a manager level DSE training course in order to interpret outcomes of the assessment.

This thread should be about the application of legal requiremrents not our personal feelings on a the bit of legislation, as this detacts from the usefulness of the forum.
If someone wants to express their feelings then they should do so in a post dedicated to this rather that hijacking someone elses thread.

You have a duty of care to everybody affected by your company’s activities, including to members of the public, and you are vicariously responsible and liable for your engineers actions.
Consider the consequences if your engineer is the cause of a road traffic accident and somebody is seriously hurt.
Moral - Personal suffering and potential serious injury?
Financial - Financial loss for injured party.
Financial - Financial loss for your company.
Legal - Prosecution of your company, potential fine or imprisonment.
I my view you would personally bear responsibility should an incident occur as you have been made aware of earlier situations making an event foreseeable.
The above is all hypothetical at the moment, but you would be advised to assess the risk and possible controls.

The bill in its current form has this exemption statement:
Exemptions
(2) Examples of descriptions of premises which may be specified are the following
(a) premises where a person has his home, or is living whether permanently or temporarily (including hotels, care homes and prisons???.
I would assume that that your accommodation may well fall into this category?

I would suggest that the only practical way this can be enforced/policed is during inspections by the enforcing authority on either routine or ad-hoc inspections. As is the case with most other workplace legislation.

With the pending smoking in enclosed spaces ban due to come into effect July 01 2007, I imaging that there will be much discussion over the interpretation of this bill.
My question is regarding this exemption statement:

(2) Examples of descriptions of premises which may be specified are the following
(a) premises where a person has his home, or is living whether permanently or temporarily (including hotels, care homes and prisons???.
Does this mean that an apartment, within an office block used for traveling employees can be considered exempt from the ban?
