I am totally confused over the new entitlement. Our Staff have 20 days, plus Bank Holidays, but usually work them at an enhanced rate of pay. Does this mean that we can no longer be open on Bank Holidays?

In answer to Jayne Heason: I run a Lorry Park on the A14 at Nacton, Suffolk. I consider that the Highways Agency refusal to allow us to have any sign could lead to the consequences that you mention. How are drivers supposed to know that they can pull off the A14 for a proper break if there is no sign to inform them that we are a Lorry Park?
Don't the Highways Agency have a duty of care toward all road users?

I manage a business which is accessed directly from the A14 at Nacton, Suffolk.
Some of my staff cycle or ride small scooters to work. Strictly speaking we are not allowed access from the other land owned by us (the Farm) BUT all these employees are instructed by the company to use this much less risky access.
The local planners are not very kindly disposed to us at the moment, so how do I go about making this situation legal? There is also a bus stop on the A1156 which gives pedestrian access through the farm to our facility. I use this myself as I don't drive. Anne Blowers

Thank you for the info. We have a Solicitor to act for us, as we are so new to this. He thinks that the case may be dropped last minute.
We will acquire the publications you suggest, they will be helpful in the long term.
The employee in question only worked for us for 4 months, so was not entitled to a written reason for dismissal. We did take legal advice, but the Disability claim is the only discrimination that seems to provide a loophole.

An employee who has a medical problem which is undergoing investigation, behaves in such a way as to be suspended, and subsequently dismissed for gross misconduct according to the terms and conditions of his contract. He is taking us to a Tribunal for discrimination because of his possible future disability due to a recovery period of three months plus IF he has to have an operation.
Can you please define disability in this context.
We feel that the case is malicious rather than serious as his references have also proved false.
