Hello,

When the smoking ban comes into force I was told that workplaces will have an exclusion zone around them and that smokers will have to stand in the street. Who will be responsible for keeping that area clean (dog ends)?

Perhaps the fines need to increase as it doesn?t seem to worry some people they seem to think the risk of a fine is worth it, a sad reflection on our socity.

How deep does the SIA go? Security workers who patrol / control construction sites are they covered by the regulations as often the principal contractor employ operatives to do this work.

What about the wider picture, with new councils now talking about doing away with bus lanes, where is the incentive for staff to use public transport in London as the bus is going to become very unreliable when stuck in traffic.

Our head of department has been made redundant and we have been told that the under manager must take on his work.

This has caused a problem as he is already overstreached.

Is this legal?

Personally there is nothing worse than having to run the gauntlet of smokers when going in or out of a building; I also feel it?s not a very good for the corporate image.

Yes, need to be carful but not killjoys, I remember this from the European cup same old thing, adds to the myth that anyone in safety is an anorak! Sad world.

The building we work in is over ten years old and has a smoking room.

There is a comms room next to it and the engineers have to access/egress it via the smoking room.

We feel this is wrong and would like to close the smoking room.

There is a purpose built shelter outside and we have offered staff coats and umbrellas if needed, there is also another smoking room on the complex in another building next to the staff restaurant.

How do we stand legally when it comes to smoker?s rights?

Hello and Good Morning,

Very interesting listening to David Sharp?s audio summing up about the case. He mentioned ?Interserve? Are they the maintenance contractor for the council and are they the large company based in the Liverpool area? What part did they play in the court case?

As David said it is a very important case for all of us in the property business.

Good morning,

A member of staff will be due for maternity leave soon her, job has just been put at risk and she will be served notice in the near future, every effort has been made to find a similar role but it is unlikely there will be one. How does this affect her entitlements with regards to payouts?

Firstly, the room should have been surveyed prior to any works on site due to the likelehood of asbestos being present.

The second stage: Only a licenced contractor can remove and dispose of the asbestos containing materials so we either have training for competancy for the removal contractors operatives to remove the boiler or they can employ an operative with boiler removal skills who is competant and trained for working in asbestos hazard invironments with medical checks.

Either way, some operatives will require competance skill in both areas.

This should and be fully compliant with the Asbestos Licencing Regulations and the Control of Asbestos at Work Regulations 2002
