Once all adjustments have been made, and the back problem continues, its not for the employer to diagnose the back problem but a trained medic? should the employer be told what the cause of the back problem is before we can look at alternative chairs or have a bespoke chair made?

I'm fully aware of the rights of a homeworker, and if they are contracted to work from home one day or two days a week we are entitled to ensure they have the right workstation set-up etc as those who work from an office. My concern is we have staff that work from home occasionally and this will probably increase, I have no idea who and when this happens, should I ensure those who occasionally work from home carry out a risk assessment and if they are not happy with their workstation chair ensure we purchase them a new one etc?

If colleagues want to work from home occasionally should we be carrying out assessments on them? or should we classify them as homeworkers?

Our workstation chairs meet the DSE Regs. How should I deal with colleagues who complain about a bad back and seek an alternative chair. Should they be providing some advice on the spec of a new chair from their Physio?

I'm often asked whether flexible/remote workers have the same H&S rights as Homeworkers. I'm reluctant to say yes, does anyone know if they fall under the DSE regs or any other legislation?

Assessments should be carried out when new staff join, when staff move desks, when staff are issued with new kit and have returned from sickness due to workstation related issues or maternity leave. We have purchased an online training and risk assessment package.

We are tenants in a 8 storey building in Holborn, staff on higher floors tend to complain of vibrations, we blamed the building works across the road. Vibrations have been felt even when the building works have ceased. I'm struggling to come up with some answers, is this a common problem with buildings in London? should the landlord be investigating it?
