You're quite Nicholas, my apologies, the article has been corrected.
As you say you cannot be charged with manslaughter under any part of the HSWA. But Section 37 (1) says that if an offence committed by the body corporate, was committed with the concent, connivence, or attributable to neglect by, the company's director, manager, secretary or an equivalent officer, they can be found guilty of the offence as well as the company and punished accordingly.
The owner and director couldn't be charged with manslaughter under the act itself, but he could be charged with it as a result of this section.
