yes i agree with this outcombe from the employers point of view, however this is a easy option for any company, this persons contract of employment was with a agency and not the company. if the company is happy with the way this person works given that this person has worked thier for seven years, then you would have thought that the comany would take this person on full time.

Thier would be a fair reason to dismiss this employee, but only when he has been incarserated due to the fact that he would be in breach of his contract. In other words the contract maybe frustrated, unworkable.
